    Kalvo Acceptable Use Policy

    This Acceptable Use Policy ("AUP") is part of the Agreement. Violation may result in immediate suspension or termination without refund. Statutory damages and regulator fines for unlawful calling are your responsibility, not Kalvo's.

    1. Customer is the initiator

    You are the initiator and sender of every call. Kalvo provides software as a passive conduit. You are responsible for legality, lists, cadence, scripts, and conduct.

    2. Prohibited conduct

    You will not: (a) violate TCPA, TSR, Truth in Caller ID, CAN-SPAM, CASL, CRTC Rules, Criminal Code s. 184, PECR, GDPR, UK GDPR, or state mini-TCPA / recording / collection laws; (b) call DNC-listed numbers without proper consent or relationship; (c) call outside permitted local hours; (d) spoof or mislead caller ID or fail to identify yourself and callback number; (e) use autodial, prerecorded, AI-voice, or ringless voicemail without required consent; (f) record or monitor without all-party consents where required; (g) call anyone who revoked consent or asked to be on your DNC list; (h) harass, defraud, or act unlawfully; (i) operate prohibited high-risk verticals if Kalvo designates them in writing; (j) upload malware; (k) circumvent security; (l) scrape or reverse engineer beyond law; (m) resell without written consent; (n) harvest others' data from the Services; (o) infringe third-party rights.

    3. Twilio and provider flow-down

    You comply with Twilio's AUP (https://www.twilio.com/legal/aup) and other underlying providers as if those terms applied directly to you.

    4. DNC and consent

    Maintain proof of consent; scrub registries at least every 31 days; register and pay for National DNCL / US DNC / state DNC as applicable; respond to complaints and notify Kalvo within 5 business days when required.

    5. Suspension

    Kalvo may suspend or terminate immediately for regulator inquiries, Twilio Trust & Safety, elevated complaint metrics, or reasonable belief of breach.

    6. Indemnity

    Section 8 of the Terms requires you to indemnify Kalvo for TCPA, CASL, CRTC, FCC, FTC, PECR, ICO, and DNC-related fines and claims arising from your use.
